A plan by U.S. Customs and Border Protection (CBP) to collect personal information on every traveler coming into the country and keeping that information in a database for 15 years could have huge privacy implications for U.S. residents, one privacy group said.

The Center for Democracy and Technology (CDT), in comments filed Monday, said CBP's plan raises serious privacy concerns. CBP is part of the U.S. Department of Homeland Security.

The CBP proposal, published as a federal notice in late July, represents a "vast scope of data collection," because data wasn't formerly kept for U.S. citizens crossing into the country by land, the CDT said.

In addition, the 15-year retention period for the data is "excessive," wrote Gregory Nojeim, senior counsel at CDT. "It cannot be justified as necessary for determining whether the record subject is admissible or is dangerous or is the subject of an outstanding criminal warrant," he wrote in the CDT filing.

The CBP plan also allows for the agency to share the information with other federal, state, local, tribal or foreign government agencies for a wide variety of reasons, Nojeim wrote. The CBP proposal allows information to be shared with government agencies responsible for investigating, prosecuting, enforcing or implementing a "statute, rule, regulation, order or license" when CBP believes that information would help the enforcement of civil or criminal laws or regulations.

In the past, CBP could only share information when it became aware of a violation or potential violation of laws or regulations, Nojeim noted.

Two DHS spokesmen did not immediately respond to a request for comments on the CDT filing.

"The priority mission of U.S. Customs and Border Protection is to prevent terrorists and terrorists' weapons from entering the country while facilitating legitimate travel and trade," the CBP proposal said. The information will be used for multiple purposes, including screening people "who may be or are suspected of being a terrorist or having affiliations to terrorist organizations, have active warrants for criminal activity ... or have been otherwise identified as potential security risks or raise a law enforcement concern."

CDT also raised concerns that there are no additional restrictions on sharing information from secondary inspections, usually done when border officials believe the person has committed a crime or is a foreigner not eligible to enter the U.S. "Release of this information can cast a cloud on a person who has done nothing wrong," Nojeim said.

CBP has also come under fire by privacy advocates in recent months for searches of laptops at U.S. borders without having specific suspicions of criminal behavior. CBP and DHS officials have defended the practice of searching a small number of laptops by saying it helps catch terrorists and other criminals.

This is just another tragic example of the madness permeating America today under the lies perpetuated by our OUT OF CONTROL Gestapo Homeland Security GOONS!

You should be aware that ALL your personal information is going to be entered into an American Gestapo TYPE data base for 15 years each time you travel to and return from Mexico.

If traveling to Mexico one should be aware that the US Government has enacted a new law whereby all your Electronic Equipment-Gear can be checked or actually "CONFISCATED" when you return back into the USA.  This includes all computers, hard drives, cell phones and any other electronic gear.  At this time, your computer could actually be "STOLEN" by American Border Agents and never returned.  There is a "no probable cause clause" involved and you could be singled out for electronic confiscation at any time "FOR NO VALID REASONS" and you are taking a RISK of losing all and any electronic data or equipment any time that you cross back into the USA from Mexico. The loss of all your personal information stored in cell phones or computers could be very costly, so if you don't want to share or actually lose all your electronic equipment, a wise decision would be to just not bring it with you. 
This is truly a sad day in America when members of a Federal Agency can STEAL your data-equipment with no probable cause to do so! What ever happened to the Fourth Amendment to our Constitution??????

If you don't mind losing all your personal data, banking info, passwords, internet browsing history, computer hard drive, cell phone info and or even having "all" your electronic equipment "STOLEN" by American Border Agents, then by all means take all your electronic gear with you while visiting Mexico, but be forewarned; you are taking a risk of losing any or all electronic gear upon return to the US border!

Washington, DC - Congressman Ron Paul is an original cosponsor of legislation introduced July 31st that would ensure that a traveler entering the United States would be subject to searches of their data and digital equipment only if a border agent has a reasonable suspicion to believe the traveler is or is about to be engaged in criminal activity.

In an August 1, 2008 front page story, the Washington Post exposed the ease with which the government can search and/or seize a traveler’s laptop, blackberry, or any other electronic device. A border agent can require any individual to provide access to private or other sensitive data with no probable cause. They can require the owner to surrender their password for encrypted data as well.

“The Fourth Amendment to the Constitution acknowledges the right of the people to be secure in their persons and effects against unreasonable searches and seizures. It is unfortunate that it takes more legislation to remind border agents of this Constitutionally protected right, but it is apparent to me that HR 6702 is absolutely necessary,” stated Congressman Paul.

Pitch sez:
We hope that a majority of other elected officials feel the same as Congressman Paul and will vote to ensure that the necessary safeguards are put in place at our borders to protect innocent American tourists returning home from Mexico.  However, with the present mindset of many so-called officials in our crime ridden capital, I would not bet that this legislation will be enacted anytime soon.  This is just another loss of each American's Freedom and how tragic that in the year 2008 we find it necessary for a vote to be taken to protect our fourth amendment rights spelled out in our constitution.  Just another tragic example of the madness that prevails and has overtaken Sin City DC.  

In the interim, prudence should be exercised in regard to taking electronics into Mexico, at least until such time that one can be assured that your equipment will not be plundered or stolen without due cause! 
 


If you are planning a drive-in trip to Mexico this season you should be aware that there will be spot checks at all USA Border Stations when returning back into the USA.  Therefore, even if you are traveling to a destination in Mexico that does not require you to obtain a visa or vehicle, boat permit; you should always take your current Passport, Birth Certificate or certified copy thereof along with a valid drivers license as proof of citizenship if you are checked while crossing back into the USA. The new Passport Law for driving into Mexico does not actually become mandatory until June of 2009, when all those entering Mexico by any form of transportation will be required to have proper documentation, to include a valid US Passport. However, as noted above, there will be spot checks all along the US Border until the new law becomes mandatory in June 2009; so be sure and take your documents on any drive in trip, even if only to visit a border town or city along the Mexican border.  Be smart and save yourself a long tedious process when returning back home and have all your documents in order.

Here's some good news for all that have put off purchasing an American Passport.  The US State Department has changed the Passport requirement date for those driving into Mexico.  The new date requiring one to acquire a Passport to re-enter the USA by automobile has been changed to June of 2009. So until that date, or other changes are made; an ORIGINAL Birth Certificate or Certified copy thereof and valid driver's license will still get you into Mexico and back into the USA.  The State Department has been totally overwhelmed with Passport applications for the past many months, but the agency is finally delivering Passports in a timely fashion once again; with 4-6 week delivery times from the date of receipt of your application.  The Agency also offers an expedited option for addition charges with a 1-2 week delivery time.

Driving or flying into Mexico can be a great adventure, but you need to make sure all your paperwork is in order or your fun will be cut short before it begins!

Tourist Permits along with Vehicle, Boat, Motor and Trailer Permits are required for all trips into the interior of Mexico which by definition is any trip into Mexico that you pass through a Federal Checkpoint!  If you do not have all the proper Mexican Documentation you will be turned around and you will not be allowed to enter the country.  If traveling to border towns-cities or short distances within the country you are not required to obtain a vehicle-tourist visa permit or purchase one of the new 10-year boat permits.  A good example of this is if you are driving to Sugar Lake, Tamaulipas.  No vehicle, visa or long term boat permits are required.

However, always be prepared for a long line and possible wait time when returning back into the USA at any border crossing, as the American Border Patrol is checking all vehicles-boats much more thoroughly with the heightened Terrorist activities which have specifically targeted the USA in recent years.

1. This is a very important new law recently passed by the Mexican Government.  According to this new law, it is UNLAWFUL to operate a motor vehicle in Mexico unless drivers of said vehicle are covered by a VALID Mexican Insurance Policy!   In other words Insurance that is actually issued by a legitimate Mexican Insurance Company. There are several US Insurance Companies that declare that the insured are covered within a certain area along the borders in Mexico.  However, this clause and endorsement is no longer recognized valid  by Mexican authorities.  You need to be aware that all Auto accidents in Mexico are considered as CRIMINAL offenses regardless of fault and all involved vehicles are generally impounded and those persons involved can be and are often placed in jail.  It is absolutely imperative that you purchase VALID Mexican Insurance from a reputable Mexican Insurance Company.  I provide Mexican Insurance from one of the most reputable and largest Insurance Companies in all Mexico.  Our coverage always includes attorneys, bail bondsmen and other Legal Aid as may be required along with personnel that speak both fluent English and Spanish and who know all the unwritten rules that must be traversed.  Beware of so-called cheap, too good to be true Mexican Insurance Policies and quotes, especially that are sold all along the border areas or on the internet; as they almost never provide all the protection and coverage that you will need if you are involved in an accident and many times they do not pay a claim; ever!  If you do not know the agency and their reputation, you can of course check online, but better yet I offer very competitive rates from one of the largest Mexican Insurance Companies in Mexico.

2. One other very important note; if you are under the influence of alcohol or drugs and are involved in an auto accident in Mexico, your Policy may be determined to be null and void!  So, don't even think about driving while intoxicated.  If you think American Prisons are bad; you do not want to ever be confined in Mexico.

3. Pets may be brought into Mexico, however, there are very stringent laws and regulations on both sides of the border for bringing in your pet.  It is much easier to board your pet, but if you must bring in your best friend, current various documentation is required.  For the most current information please check with your Mexican Consultant or US State Department.

4. If fishing in Mexico a valid Fishing Permit must be in possession by all persons in your boat. No exceptions.  If you are making a full service package trip your fishing permits are always provided by your Lodge or Outfitter.

If pulling your own boat, a valid current Fishing Permit is required for each person in your boat.  If traveling into the interior of Mexico, you will also be required to purchase one of their new 10 year boat permits at the time of crossing the border.  You are issued a decal which is required to be placed on your boat.  The 1 year boat permit is no longer required.

5.   The Mexican Government has recently INCREASED the costs for ALL Fishing Permits as of mid 2007.

You will be DENIED ENTRY INTO MEXICO unless you meet the above mentioned criteria and requirements!

2.  Save yourself the disappointment of being turned away at the border and prepare all your documents and paperwork for entering into Mexico properly.  I have recently had numerous customers that have been turned back at the border and had to return home because they did not take the time and effort to make certain all their paper-work was in in proper order.  It is a very simple and easy procedure to obtain a vehicle-boat-tourist entry permit if you take the time to be certain that you meet all the current requirements for entering Mexico.  Please call me anytime if you have questions about what is required. 

3.  If you are planning to carry extra fuel for your boat while in Mexico, you must purchase this fuel in Mexico.  No gasoline in drums is being allowed to cross the border.  Gasoline prices are comparable or even cheaper than in the USA and Mexico's premium Gasoline is refined to 93 Octane; which is higher than can be purchased at most stations in the USA!  Mexico's refineries produce some of the best gasoline products in the world and their gasoline is completely safe to use in all Outboard boating applications and new American Vehicles.  There is absolutely no need to bring gasoline into Mexico with the present HIGH GRADE of fuel being sold at all Pemex Service Centers.

4. *****It is very important that you turn in your Tourist & Vehicle permits before crossing back into the USA.  You may be denied access into Mexico again if you fail to turn in your paperwork!  The Vehicle Permit has to be scanned by a proper Mexican Official (where the permits are issued at any border crossing) before removal.  You will be denied entry into Mexico once again if you do not turn in this permit properly.  Be pre warned that this is not an easy task at many border crossings and you'll have to spend considerable time and effort to do so****

 


Mexico Entry Requirements For Driving
Into Mexico

1. To obtain tourist permits, a current Passport, Original Passport or Certified copy of your Birth Certificate are needed for each individual traveling into the interior of Mexico.  Tourist Permits are issued on a no-charge basis if your planned trip into Mexico is for 7 days or less.  The standard Tourist Permit is issued for 180 days and is paid for by Credit Card at the issuing office.  Voters Registration Cards are no longer excepted as valid proof of citizenship at most border crossings; so be smart and apply for a Passport or obtain a certified copy of your BC from the State where you were born.

2. For vehicle, boat, motor and trailer permits, the Owner's "ORIGINAL" Vehicle and other "ORIGINAL" Titles-Registration Receipts (if applicable) are all needed. All vehicle-boat permits must be paid for by credit card at the time of issue and this permit must be surrendered when re-entering the USA.  This is very important.  The Mexican Government is no longer allowing these permits to be mailed back from the US, as all vehicle decals are computer scanned at the time of surrender with parcel removal of this decal.
   
3. If the vehicle-boat are financed, rented, leased, and/or a company/corporate vehicle-boat, it will be necessary to bring along a notarized letter of permission from the lien-holder's) or lending-rental institution stating that you have permission to drive into Mexico. If a company vehicle-boat; a letter of authorization must be written on company's letterhead, signed by an officer of the company and notarized.  This is all very important, as the current Mexican-Border crossing situation is changing almost daily and I cannot over emphasize how IMPORTANT IT IS TO HAVE ALL YOUR PAPER-WORK IN PROPER ORDER FOR A HASSLE FREE CROSSING!

5. Visa, MasterCard, Diner's, or American Express card with the same name as vehicle's title. 
  
6. You MUST return the vehicle and boat back to the United States before the 7 day or 6 month expiration time frame.  A receipt will be issued when the permit is cancelled. Failure to turn in your permits before the expiration date may result in denial of entry into Mexico on your next trip, impoundment of vehicles-equipment or fines imposed.
  
7. No borrowed vehicles or borrowed credit cards are accepted.

8.  If you do not meet the above criteria, you will be confronted with long delays or actual denial of entry into Mexico!  Don't take a chance on ruining your trip before it gets started; make certain you have all the proper and necessary documentation before departing!

9. Valid Mexican Vehicle-Boat Insurance is required for one to drive into the interior of the country.
